Terms of Service

1. Agreement

These Terms govern your use of OET Live (the “Service”), operated by OET Live. By creating an account, signing in, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old. If you use the Service on behalf of an employer or institution, you represent that you have authority to bind that entity to these Terms.

3. The Service

OET Live provides AI-assisted role-play practice, automated scoring, and feedback to help you prepare for the Occupational English Test (OET) Speaking sub-test.

OET Live is not affiliated with, endorsed by, or sponsored by Cambridge Boxhill Language Assessment or any official OET body. The OET name and rubric are referenced for educational comparison only. Scores produced by the app are an AI-generated estimate to help you study; they are not official OET scores and do not predict, guarantee, or substitute for official OET results.

4. Your account

• You are responsible for keeping your sign-in credentials confidential.
• One person per account. Sharing accounts is not permitted.
• You agree to provide accurate information at sign-up and to keep your profile reasonably current.
• You can delete your account at any time from Profile → Privacy → Delete account.

5. Acceptable use

You agree not to:

• Use the Service to upload unlawful, harassing, or harmful content.
• Attempt to scrape, harvest, or systematically extract the case bank, scoring outputs, or AI patient responses for redistribution.
• Reverse-engineer, decompile, or extract model weights or prompts from the Service.
• Bypass usage quotas, share access with third parties, or use automated tools to inflate practice counts.
• Interfere with the operation of the Service, the AI patient, or the scoring pipeline.
• Submit content you do not have the right to submit, or that infringes another person's rights.

6. Your content

You retain all rights to the audio you record, transcripts derived from it, and any feedback notes you write. By using the Service, you grant us a limited licence to process this content as described in our Privacy Policy — strictly to deliver the Service to you (transcription, scoring, AI response generation, storage for replay).

7. Subscriptions and billing

• Free tier. Every account includes 1 scored exam role-play and 10 Coach minutes at no charge and without a payment method. These are one-time allowances; they do not renew.
• Free trial. Eligible new subscribers may start a 3-day free trial of the Essential monthly plan. The trial includes up to 30 practice minutes. A valid payment method is required to start it. Unless you cancel before the trial ends, the subscription converts automatically to a paid Essential monthly subscription at the price shown at sign-up, and you are charged at the end of the trial and every month after that. For a trial started in the iOS app, Apple requires you to cancel at least 24 hours before the trial ends. Cancelling during the trial keeps access until the trial ends, and you are not charged. A free trial is available once per person, Apple ID and device; we may decline or end a trial we reasonably believe is a repeat or abusive use.
• Paid subscriptions. Higher-quota plans are sold through Apple In-App Purchase in the iOS app and through Stripe in the web app.
• Auto-renewal. Subscriptions renew automatically until cancelled: in your App Store subscription settings for a purchase made in the iOS app, or under Billing in the web app for a purchase made on the web.
• Refunds. All charges, including the first charge after a free trial ends, are non-refundable, and we do not provide refunds or credits for partially used billing periods or unused minutes, except where required by applicable law, in case of a duplicate charge or billing error, or as described in section 11. Cancelling stops future renewals; access continues until the end of the period already paid for. Purchases made through Apple are billed by Apple, and any refund request for them is decided by Apple under its own policies, not by us. When you purchase through Apple, you agree that we may share limited consumption information with Apple to assist with refund reviews, as described in our Privacy Policy. You may withdraw this consent at any time. For a billing error on a purchase made in the web app, which Stripe processes for us, contact info@oetlive.com.
• Top-ups. One-time top-up bundles add practice minutes on top of your plan and are spent only after your plan's monthly minutes. Some bundles (for example Exam Sprint) are valid for a limited window — 90 days from purchase — after which any unused minutes expire; the validity period is shown at purchase.

8. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate accounts that violate these Terms or that create operational, security, or legal risk for the Service or other users. Where reasonable, we will warn you first.
• On termination, the data-deletion rules in the Privacy Policy apply.

9. Disclaimers

The Service is provided “as is” and “as available”. AI-generated patient responses, transcriptions, and scores can contain errors, omissions, or misjudgements. OET Live is study support, not exam preparation certification. We do not warrant that the Service will be uninterrupted, error-free, or that any specific exam outcome will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, OET Live and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising from your use of the Service.

Where liability cannot be excluded, our total liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or AUD 100, whichever is greater.

Nothing in these Terms excludes any liability that cannot lawfully be excluded, including under the Australian Consumer Law or equivalent consumer-protection laws in your jurisdiction.

11. Changes to the Service

We may add, change, or remove features at any time. For material changes that reduce functionality you have paid for, we will provide reasonable notice and, where appropriate, a pro-rata refund or credit.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app and, where required by law, by email. Continued use after the effective date of an update constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. Disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, except where mandatory consumer-protection law in your jurisdiction provides otherwise.
